Terms of Service
Who we are
Blushing is a service operated by Cakesfam Online Shop, a sole proprietorship registered with the Philippine Department of Trade and Industry (DTI Business Name No. 5462110), based in Taguig City, Philippines. You can reach us at hello@blushing.app. In these Terms, "we", "us", and "Blushing" refer to Cakesfam Online Shop operating the Blushing service.
The service
Blushing lets you create and send a digital invitation ("ask"), which a recipient can answer. Creating and sending an ask is free. When an ask is answered, the creator may choose to pay a one-time fee to unlock the answer's plan details (date, time, and place). The fee and the details of the offer are shown to you before you pay.
Payments
Payments are processed by our payment provider, PayMongo, via QR Ph. Charges are in Philippine Pesos and inclusive of any applicable taxes. On your bank or wallet app the merchant appears as "Cakesfam Online Shop", and on your statement the charge is labelled "Blushing". We do not receive or store your card, bank, or wallet credentials — those are handled by PayMongo.
Acceptable use
You agree not to use Blushing to:
- harass, threaten, deceive, or contact anyone unlawfully or against their wishes;
- impersonate another person or misrepresent your identity;
- send invitations in bulk, by automated means, or to people who have not consented to hear from you;
- interfere with, probe, or abuse the service or attempt to bypass payment or security controls.
No guarantee of outcome
Blushing is a tool for sending an invitation — not a promise of any result. We do not guarantee that a recipient will open, respond to, or accept your ask. The unlock fee reveals the plan details of an already-answered ask; it does not purchase an outcome.
Availability and changes
We aim to keep Blushing available and working, but we provide it on an "as is" and "as available" basis without warranties of any kind. We may update, suspend, or discontinue features, and we may update these Terms; material changes will be reflected by the "last updated" date above.
Limitation of liability
To the fullest extent permitted by Philippine law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages. Nothing here limits rights you have under the Consumer Act of the Philippines (R.A. 7394) or other mandatory law.
Governing law
These Terms are governed by the laws of the Republic of the Philippines. Questions or disputes may be raised with us first at hello@blushing.app.
